8. Security Disclaimer and Limitation of Security Liability
IMPORTANT - PLEASE READ CAREFULLY: The HoneyCloud™ Platform and HoneyTrap Pro™ Appliances are DETECTION tools designed to identify potential threats. They are NOT security prevention systems and do NOT guarantee protection against cyberattacks, data breaches, or unauthorized access.
8.1 No Guarantee of Security
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- No security product, including the Service and Appliances, can guarantee complete protection against all cyber threats, attacks, breaches, or unauthorized access
- The Service is designed to DETECT and ALERT, not to PREVENT security incidents
- Honeypot technology, by its nature, is a passive detection mechanism that operates after an attacker has already entered the network
- The effectiveness of the Service depends on many factors outside our control, including your network configuration, security practices, and the sophistication of attackers
- New and unknown attack vectors ("zero-day" attacks) may not be detected
8.2 Your Security Responsibilities
You acknowledge that you remain solely responsible for:
- Implementing comprehensive security measures beyond honeypot detection
- Maintaining firewalls, endpoint protection, access controls, and other security tools
- Responding appropriately and timely to alerts generated by the Service
- Training your personnel on security best practices
- Maintaining data backups and disaster recovery procedures
- Complying with applicable security regulations and standards
- Conducting regular security assessments independent of the Service
- Your End Customers' security posture and practices
8.3 No Liability for Security Incidents
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CROSS COUNTRY COMMUNICATIONS CORP. SHALL NOT BE LIABLE FOR ANY:
- Security breaches, cyberattacks, or unauthorized access to your systems or your End Customers' systems, regardless of whether the Service was in use at the time
- Data theft, data loss, data corruption, or unauthorized disclosure of data
- Ransomware attacks, malware infections, or other malicious software
- Business interruption, downtime, or operational disruption caused by security incidents
- Regulatory fines, penalties, or legal costs arising from security incidents
- Reputational harm or loss of business relationships
- Failure of the Service to detect any particular threat or attack
- Delayed, missed, or undelivered alerts
- False positives or false negatives in threat detection
- Actions taken or not taken in response to alerts from the Service
8.4 Assumption of Risk
By using the Service, you expressly assume all risks associated with cybersecurity threats and acknowledge that the Service is one component of a comprehensive security strategy, not a complete security solution. You agree that your decision to use the Service does not transfer any security risk or liability to Cross Country Communications Corp.
8.5 No Insurance Substitute
The Service is not a substitute for cybersecurity insurance. We strongly recommend that you maintain appropriate cyber liability insurance coverage regardless of your use of the Service.
8.6 Third-Party Integrations
The Service may integrate with third-party security tools, firewalls, RMM platforms, and EDR solutions. We are not responsible for the performance, availability, or security of any third-party products or services, and we make no warranties regarding their effectiveness in preventing or responding to security incidents.
9. Data Ownership and Rights
8.1. Your Data: You retain all ownership rights to data you upload or generate through the Service ("Subscriber Data"). You grant us a limited license to use Subscriber Data solely to provide the Service.
8.2. Threat Data: Threat Data collected by Appliances may be used by us in anonymized, aggregated form to improve the Service and contribute to collective threat intelligence (subject to your opt-in consent).
8.3. Feedback: Any suggestions, ideas, or feedback you provide may be used by us without obligation or compensation.
10. Threat Intelligence Sharing
9.1. The Platform offers optional threat intelligence sharing that allows anonymized threat data to be shared among participants.
9.2. Participation is voluntary and can be enabled or disabled in your account settings.
9.3. Shared data never includes identifying information about you or your End Customers.

10.2. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the subscription term.
10.3. You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer or attempt to extract source code.
12. Confidentiality

- Whether any limited remedy fails of its essential purpose
- The form of action (whether in an individual action, class action, or representative action)
14.4. YOU ACKNOWLEDGE THAT THE FEES CHARGED REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT AND THAT WE WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS ON LIABILITY.
